Hybrid trust structure for a family business
There is a family business which has been owned by a client family for several generations. It has been within a trust structure, however, only for one generation. Working with counsel to the family, I am looking to get to a position where the business and supporting entities will be held within a hybrid trust which better reflects the family’s long term intentions of preserving the business for future generations whilst intermittently and on an “as needed basis” benefit can come out to the family.
Restructuring of two Jersey law trusts
Advising a family on all Jersey law issues in connection with the restructuring of two Jersey law trusts holding financial assets and a Europe-based business. Drafting new Jersey settlements and all supplementary trust documentation so as to effect the restructuring. To further drafting all Jersey law transaction documents to include all trustee and corporate resolutions and to liaising with the trustee, and all UK, US and European counsel throughout.
Advising on an interesting trust structure
Advising a Swiss based trustee in relation to an interesting trust structure created a number of years ago for a Southern European family which, inter alia, holds a share in the family business. The client wished to assist the family in a major restructuring so as to enable the overlying trust to ultimately provide benefit not only to the family but for former employees of the family and for philanthropic purposes.
