Litigation with combined claims of US$1.5 billion
I am acting as adviser in Guernsey’s largest ever piece of substantive litigation, advising the Carlyle Group and Carlyle Investment Management LLC, both of which are defending claims brought by the liquidators of Carlyle Capital Corporation Limited, a Guernsey investment fund, which was placed into compulsory liquidation in 2008. The combined claims against all of the defendants seek around US$1.5 billion and were commenced initially in July 2010, following which the parties were engaged in a two year dispute in relation to the forum of the litigation.

Advising a beneficiary of a Guernsey-law trust about the scope of any indemnity to which an outgoing trustee is entitled in circumstances where investigations and litigation is taking place in Europe and the trust has suffered substantial losses in an investment, which was also advised and managed by persons connected to the outgoing trustee in the Caribbean.
