Advised on giving through an existing charity or setting up a new one and registering it with the Charity Commission and HMRC.
The matter is of particular interest as it involved an innovative way of avoiding registering a new charity with the Charity Commission and HMRC by creating a subsidiary restricted trust containing the various donors’ requirements and involved the application of charity and canon law in relation to the ultimate beneficiary, The Vatican. Alongside was a commercial sponsorship deal which needed to be kept separate for charity and tax law reasons.
