Case Studies

Client work includes:

  • I appear as counsel in trust administration proceedings before the Royal Court of Guernsey, arising out of and running parallel to hostile proceedings in the Judicial Committee of the Privy Council relating to the administration a Jersey Law Trust during the years immediately prior to and following the collapse of the Icelandic bank, Kaupthing Hf. The trust administration proceedings have focused on how the assets of the trust are to be administered pending the determination of the various claims now in the Privy Council. I am instructed by and act for the current trustee of the trust. There have been more than 45 applications in the trust administration proceedings since their commencement in 2010. I have been lead counsel since 2014.
  • I am also involved in the hostile Privy Council proceedings referred to above. I act for the trustee in two, long running and highly publicised disputes involving investment businesses associated with a well London property investor. The proceedings were before the Privy Council in November 2017, in a four day appeal hearing.
  • I act for the trustee and certain beneficiaries of a Guernsey pension trust, in a dispute before the Royal Court of Guernsey relating to a trust which had been established for the benefit of an international footballer and his family. Owing to minors being within the classes of beneficiaries of the trust, and the fame of the principal beneficiary of the trust, the dispute is being heard in private. The application involves matters of trust and private international law and will likely to lead to a public judgment being handed down at the conclusion of the matter which will prove invaluable to the local bar and to English lawyers engaged in matters before the Family Division of the High Court.
