Resolving contentious probate and trust disputes
Nasima currently acts in a range of contentious probate and trusts disputes acting for executors, administrators, trustees, beneficiaries as well as individuals involved in disputes.
Nasima is currently acting for three adult children representing them in a claim against their father‘s estate under the Inheritance (Provision for Family and Dependants) Act 1975. The estate is complex with numerous properties and business interests. Our clients relied heavily on their father for maintenance during his lifetime. Our clients received a weekly income, payments for cars, insurance, fuel, shopping money etc. The deceased reassured them that this maintenance would continue after his death and that they would be “comfortable”. The Deceased‘s will left his entire estate on discretionary trust to his second wife (life tenant) with the remainder to the children, including a minor child. The second wife and our clients all brought claims against the estate under the under the Inheritance (Provision for Family and Dependants) Act 1975.
After some negotiation, the claims are being settled by reaching a mutually agreeable settlement to resolve the matter without the need for the parties to resort to court proceedings.
Nasima is due to complete her Association of Contentious Trusts and Probate Specialists course in June 2022, after which she will become and ACTAPS member.
