I represent the husband (H). H’s previous solicitors lacked the resources available to us as a multi-service firm and the case required Mark’s excellent strategic insight. Mark assembled a skilled team of second to none finance specialists to tackle what a matrimonial KC described at a two day Private FDR as “possibly the most highly contested case’ he had ever seen. The factual matrix is highly complicated with constantly moving parts. Arising out of the matrimonial proceedings are: (i) a shareholder dispute as between H and W; (ii) a claim for £50m made by the purchasers of a company H&W owned and which it is said was fraudulently misrepresented; (iii) a private prosecution claim against former employees, allegations in which have generated significant volumes of evidence.
Our role has been invaluable in many respects, including:
(i) Grappling with high level complex factual and legal issues across different areas of law;
(ii) Our successful pursuit, through strategy and tenacity, of proving H’s case that W has undisclosed financial resources overseas. We established an undisclosed property in Japan, offshore payments to third parties via W’s sister in Taiwan, an offshore policy worth over £500k and payments to third payments here that were complicit in the fraud against their business which gave rise to the private prosecution; and
(iii) The ability to identify, commission and coordinate experts across multiple disciplines, all with the common goal of presenting H’s matrimonial case to the highest calibre.
This is a High Court case. This case requires a strong team around it and Mark selected those across our national team who had the necessary skills as well as coordinating lawyers and experts from different fields of law to pursue and defend the various claims. One expert involved in the case said that: ‘he had done work for all of the top firms in London, but this is the most complex he had ever seen’.
