Waqar Shah acted for a client in respect of a SDLT disclosure on a large trust as a result of actions of her former spouse. The issue in this one was the client‘s husband had allegedly forged her signature and tricked her into being responsible for millions of pounds worth of property. Working alongside real estate advisers, we were able to pick up on the issue before HMRC and therefore disclose it having undertaken a full analysis of what had happened. This meant that we maintained control of the narrative and the timeline (which is incredibly important in disputes with HMRC) and it resulted in no penalty being levied. Interestingly, because of the time limits applicable, it also meant that there wasn‘t any tax left to pay as HMRC hadn‘t assessed in time.
